{"id":4779,"date":"2025-08-28T08:59:33","date_gmt":"2025-08-28T08:59:33","guid":{"rendered":"https:\/\/www.foodsovereignty.org\/?p=4779"},"modified":"2025-08-29T08:07:10","modified_gmt":"2025-08-29T08:07:10","slug":"el-cip-indica-el-camino-para-frenar-la-biopirateria-digital","status":"publish","type":"post","link":"https:\/\/www.foodsovereignty.org\/es\/el-cip-indica-el-camino-para-frenar-la-biopirateria-digital\/","title":{"rendered":"El CIP indica el camino para frenar la biopirater\u00eda digital"},"content":{"rendered":"<p data-start=\"2130\" data-end=\"2542\">De cara a la <a href=\"https:\/\/www.fao.org\/plant-treaty\/meetings\/meetings-detail\/es\/c\/1644491\/\" target=\"_blank\" rel=\"noopener\">11\u00aa reuni\u00f3n del \u00d3rgano Rector<\/a> del Tratado Internacional sobre los Recursos Fitogen\u00e9ticos para la Alimentaci\u00f3n y la Agricultura (TIRFAA), el Grupo de Trabajo sobre Agrobiodiversidad del CIP publica un documento clave dirigido a todos los gobiernos que deseen abordar el problema de la <strong>biopirater\u00eda digital<\/strong> causada por el <strong>acceso abierto a la informaci\u00f3n de secuencias digitales (DSI) sobre los RFAA<\/strong>.<\/p>\n<p data-start=\"2544\" data-end=\"2872\">El documento presenta una serie de principios para un marco jur\u00eddico nacional que limite la continua <strong>violaci\u00f3n de los derechos de los agricultores sobre las semillas<\/strong>, que hoy ocurre mediante la patentaci\u00f3n de las DSI correspondientes a los componentes gen\u00e9ticos de los recursos contenidos en el Sistema Multilateral del Tratado.<\/p>\n<p data-start=\"2874\" data-end=\"3403\">Dado que las negociaciones internacionales en el seno del Tratado se encuentran bloqueadas desde hace muchos a\u00f1os por dos facciones opuestas, <strong>es necesario que las Partes Contratantes que realmente quieran resolver el problema act\u00faen por su cuenta mediante leyes nacionales<\/strong>. Esto permitir\u00eda aplicar coherentemente la letra del Tratado, <strong>impedir la extensi\u00f3n abusiva de patentes a los rasgos nativos de las plantas y evitar la restricci\u00f3n del acceso facilitado a los RFAA<\/strong> que el pa\u00eds pone a disposici\u00f3n en el Sistema Multilateral.<\/p>\n<p data-start=\"3405\" data-end=\"3997\">La propuesta del CIP llega en un momento en que las partes contratantes est\u00e1n discutiendo una enmienda al Tratado que, de ser aprobada por el \u00d3rgano Rector, ampliar\u00eda el Sistema Multilateral a todos los recursos gen\u00e9ticos conservados en colecciones ex situ y en el dominio p\u00fablico. Esta medida, si no va acompa\u00f1ada previamente de la sujeci\u00f3n de los componentes gen\u00e9ticos digitales a las normas del Tratado, <strong>convertir\u00eda al TIRFAA en una herramienta de biopirater\u00eda al servicio de las empresas<\/strong>, facilitando la violaci\u00f3n de los derechos de los agricultores en lugar de protegerlos y promoverlos.<\/p>\n<p data-start=\"3999\" data-end=\"4428\">Con este documento, <strong>el CIP hace un llamado a todas las partes contratantes a entablar un di\u00e1logo y una colaboraci\u00f3n con las organizaciones campesinas y de Pueblos Ind\u00edgenas<\/strong> para revertir esta tendencia y aplicar medidas jur\u00eddicas que protejan firmemente el acceso p\u00fablico a los RFAA y los derechos de los agricultores, garantizando que las DSI no puedan utilizarse para privatizar y expropiar lo que pertenece a los campesinos.<\/p>\n<p style=\"text-align: center;\" data-start=\"3999\" data-end=\"4428\"><a class=\"btn btn-yellow\"
